Agreement to Terms

By accessing and using RapidHR software and services provided by RapidData IT Solutions Pvt Ltd ("Company," "we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Use License

Permission is granted to temporarily download one copy of RapidHR software per license for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to reverse engineer any software contained in the service
  • Remove any copyright or other proprietary notations from the materials
  • Share login credentials with unauthorized users

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials.

Service Description

RapidHR is a comprehensive Human Resource Management System that provides:

  • Employee information management
  • Payroll processing and management
  • Attendance and leave management
  • Performance evaluation tools
  • Recruitment and onboarding features
  • Task and project management
  • Reporting and analytics

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

User Accounts and Responsibilities

To access certain features of RapidHR, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and up-to-date information
  • Notifying us immediately of any unauthorized use
  • Complying with all applicable laws and regulations

Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of information as outlined in our Privacy Policy.

You retain ownership of your data, but grant us the necessary rights to process, store, and transmit your data to provide our services. You are responsible for maintaining backups of your critical data.

Payment Terms

Payment terms for RapidHR services are as follows:

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • Price changes will be communicated 30 days in advance
  • Late payments may result in service suspension
  • Taxes are calculated based on your billing address

Service Level Agreement

We strive to maintain 99.5% uptime for our services. However, we do not guarantee uninterrupted service and are not liable for temporary unavailability due to:

  • Scheduled maintenance
  • Force majeure events
  • Third-party service failures
  • User error or misuse
  • Network or hardware failures beyond our control

Intellectual Property

The RapidHR software, including its original content, features, and functionality, is owned by RapidData IT Solutions Pvt Ltd and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our service without our prior written consent.

Prohibited Uses

You may not use our service:

  • For any unlawful purpose or to solicit unlawful acts
  • To violate any international, federal, provincial, or state laws
  • To infringe upon or violate our intellectual property rights
  • To harass, abuse, insult, harm, defame, slander, or intimidate
  • To submit false or misleading information
  • To upload or transmit viruses or malicious code
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • For any obscene or immoral purpose

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason, including but not limited to a breach of the Terms.

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

Limitation of Liability

In no event shall RapidData IT Solutions Pvt Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, punitive, consequential, or special damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Governing Law

These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
